Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and Eternal Canvas ("we," "us," or "our") governing your access to and use of our website, online platform, and tattoo-related services. By accessing or using our website or services, by booking an appointment, or by placing a deposit, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

Services

Eternal Canvas provides custom tattoo services, flash tattoo sales, consultations, related merchandise, and content through our studio and online platform. All tattoo services are performed by licensed professionals in compliance with Colorado health and safety regulations. We reserve the right to refuse, modify, or discontinue any service at our discretion.

Age Requirement

You must be at least 18 years of age to receive tattoo services or to place a deposit. A valid government-issued photo ID is required at every appointment, and we may verify ID digitally as part of intake. We do not tattoo minors. Submitting an inquiry, booking, or deposit on behalf of a minor is a breach of these Terms and may result in forfeiture of any deposit paid.

Bookings & Deposits

A non-refundable deposit is required to confirm your appointment. The deposit amount typically ranges from $100–$200 depending on project scope, and is applied toward the total cost of your session. Deposits are collected through our secure online checkout.

By placing a deposit, you confirm that you have reviewed and agreed to the design direction, placement, and estimated session length discussed with your artist. Significant changes to the concept, placement, or scope after a deposit is paid may require an additional deposit or quote revision.

Cancellations & Rescheduling

  • 48+ hours notice — full deposit refund
  • 24–48 hours notice — 50% deposit refund
  • Under 24 hours notice — deposit forfeited
  • No-show — deposit forfeited; a higher deposit may be required for future bookings

Rescheduling is available free of charge with at least 48 hours notice. Rescheduling with less than 48 hours notice is treated as a cancellation under the schedule above. We reserve the right to cancel or reschedule appointments due to artist illness, equipment issues, or other circumstances; in those cases your deposit is fully refundable or transferable.

Pricing & Payment

Tattoo pricing is based on size, complexity, placement, artist rate, and session length. Estimates provided during consultations are approximate; final cost may vary, and any change in scope will be discussed before work begins. Sales tax is added where required by law.

Full payment is due at the end of your session unless a written payment plan has been arranged in advance. We accept major credit and debit cards and cash. Buy Now Pay Later options may be offered through third-party providers, subject to their separate terms.

All sales of flash tattoos, deposits, and completed services are final and non-refundable except as expressly stated in these Terms or as required by applicable law. Chargebacks initiated without first contacting us in good faith may result in suspension of services and collection costs.

Health, Consent & Assumption of Risk

Tattooing involves inherent risks, including but not limited to bleeding, bruising, swelling, allergic reactions to pigments or aftercare products, infection, scarring, granulomas, and changes in appearance over time. By proceeding with a tattoo, you acknowledge and voluntarily assume these risks.

Before each session you must complete and sign our consent form and disclose any medical conditions, allergies, medications, pregnancy, or other factors that could affect the tattooing process or healing. Eternal Canvas reserves the right to refuse or stop service if we determine that proceeding poses a health or safety risk. You agree that any false or incomplete health disclosure releases us from liability for resulting harm to the extent permitted by law.

Aftercare & Touch-Ups

Proper aftercare is essential to healing and is your responsibility. We provide written and digital aftercare instructions after every session. One complimentary touch-up is offered within 3 months of your session, provided the aftercare instructions were followed and the issue is not the result of injury, sun exposure, or other client-side causes. Touch-ups outside that window or due to improper aftercare may incur a fee.

Intellectual Property

All custom tattoo designs, sketches, stencils, and related artwork created by our artists remain the intellectual property of Eternal Canvas and the respective artist. You receive a personal, non-exclusive license to wear the tattoo on your body. You may not reproduce, distribute, sell, or commercially use any design — including merchandise, prints, NFTs, or AI training data — without our prior written permission.

By submitting reference images or ideas to us, you represent that you have the right to use them and that they do not infringe any third-party rights. You grant us a limited license to use those references solely to design and execute your tattoo.

Photo & Portfolio Release

We may photograph or video-record completed tattoo work for our portfolio, website, social media, and marketing. Photographs typically focus on the tattoo and are framed to avoid identifying details unless you agree otherwise. If you prefer that your tattoo not be photographed or shared publicly, please tell your artist before your session and we will note it in your file. You can also withdraw a previously given photo release for future use by emailing info@eternalcanvastattoo.com; we are not able to recall content already published in print or by third parties.

User Accounts

If you create an account on our platform, you are responsible for maintaining the confidentiality of your login credentials and for all activity on your account. You agree to provide accurate information, keep it up to date, and notify us promptly at info@eternalcanvastattoo.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe present a security or fraud risk.

Acceptable Use

You agree not to: (a) use our services for any unlawful purpose; (b) impersonate another person or misrepresent your identity or age; (c) interfere with or attempt to compromise the security or operation of our website; (d) submit reference material that infringes third-party rights or contains hateful, sexually explicit content involving minors, or other illegal content; or (e) harass our artists, staff, or other clients. We may refuse service or terminate access for violations.

SMS Program

Eternal Canvas operates an SMS program to support customers through their tattoo consultation, booking, and aftercare journey. By providing your phone number on our consultation form at /consultation/new, in our booking flow, or directly to your artist, you give express written consent to receive recurring transactional and conversational text messages from Eternal Canvas and your assigned artist.

Message frequency varies based on the stage of your consultation and booking. Typical messages include: an initial reply with next-step details after submitting a consultation; replies from your artist; booking confirmations; appointment reminders approximately 24 hours before your appointment; deposit and payment links; aftercare follow-ups; and a review request after your appointment. Message and data rates may apply, and carriers are not liable for delayed or undelivered messages.

  • Reply STOP to unsubscribe at any time. After unsubscribing, you will no longer receive any text messages from us or your artist — including booking confirmations and reminders.
  • Reply START to resubscribe after a STOP.
  • Reply HELP to receive support information.

Disclaimer of Warranties

Except as expressly stated in these Terms or required by law, our website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the site will be uninterrupted or error-free. We do not warrant that any tattoo will heal in a particular way or appear identical to any reference, mock-up, or stencil.

Limitation of Liability

To the maximum extent permitted by law, Eternal Canvas , its owners, artists, employees, and contractors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from or related to your use of our services or website, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or related to these Terms or the services shall not exceed the amount you actually paid to us for the specific service giving rise to the claim in the 12 months preceding the event. Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Eternal Canvas and its owners, artists, employees, contractors, and service providers from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) any inaccurate or incomplete information you provide to us.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or our services shall first be addressed by good-faith informal negotiation. If unresolved within 30 days, the dispute shall be brought exclusively in the state or federal courts located in Morgan County, Colorado, and you and we consent to personal jurisdiction and venue there. Each party waives any right to a jury trial and agrees that any claim must be brought in an individual capacity, not as a plaintiff or class member in any class or representative proceeding.

Severability & Entire Agreement

If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any signed consent or release forms, constitute the entire agreement between you and Eternal Canvas regarding our services and supersede any prior or contemporaneous agreements on the same subject.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes will be highlighted on our website. Your continued use of our services after changes take effect constitutes acceptance of the revised Terms.
